This episode of The Law Report focuses on the claims management regulations, which came into force in April 2007 to ensure consumers get a fair deal when using claims companies.

The statutory framework for these regulations is the Compensation Act 2006. The decision to legislate was made following the failure of the majority of the claims management industry to sign up to a voluntary code of practice.
The regulations apply to firms handling compensation claims for personal injury, criminal injuries compensation, industrial injuries disablement benefit, employment matters, housing disrepair and financial products and services. Almost any activity relating to claims is covered, from simply referring claims to representing clients.
There are some exemptions, including those who are already regulated, charities, not-for-profit advice agencies and some trade unions. Small-scale introducers, where this is incidental to their main business, do not need to be individually authorised but are subject to the conduct rules.
